This Privacy Notice is provided to meet the requirements of the UK General Data Protection Regulation (GDPR) and the Data Protection Act 2018 (DPA) to explain how we process your personal data in delivering Adult Social Care Service.
Leeds City Council is the data controller for the purposes of the Data Protection Act 2018 and other regulations, including the UK General Data Protection Regulation, which means it determines what your data is used for and why it is collected. We use your information to help us to support you, facilitate your care, and, where needed, protect you from harm.
All the data collected will be treated in strict confidence and in accordance with the requirements of the Data Protection Act 2018 and the UK General Data Protection Regulation (UK GDPR). The data provided by you will only be used for the purposes specified.
We collect and hold your information to enable us to comply with a legal obligation or because we are acting in the public interest or exercising a public task under our official authority. Our service also needs to use sensitive personal data relating to you (also called special category data), which requires more protection by us to keep it safe.
We will process your data in accordance with UK GDPR Article 6(1). The processing shall be lawful only if and to the extent that the following applies:
Article 6(1)(a): the data subject has given consent to the processing of his or her personal data for one or more specific purposes
Article 6(1)(c): processing is necessary for compliance with a legal obligation to which the controller is subject
Article 6(1)(d): processing is necessary in order to protect vital interests of the data subject or of another natural person
Article 6(1)(e): processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

We will process your special category data in accordance with UK GDPR Article 9(2). The processing shall be lawful only if and to the extent that the following applies:
Article 9(2)(a): the data subject has given explicit consent to the processing of those personal data for one or more specific purposes;
Article 9(2)(g): Substantial public interest laid out in law (need to list at least one of 23 specific substantial public interest conditions set out in Part 2 of Schedule 1 of the DPA 2018);
Article 9(2)(h): Health and social care as laid out in law (If you are relying on this condition, you also need to meet the associated condition in UK law, set out in Part 1 of Schedule 1 of the DPA 2018).
The processing of special category data under Article 9 and criminal offence data under Article 10 are further supported by the following conditions in Schedule 1, Parts 1, 2, and 3:
All the listed conditions require an Appropriate Policy Document to be in place, which sets out and explains the procedures for securing compliance with the principles in Article 5 and policies regarding the retention and erasure of such personal data. You have the right to withdraw your consent. This will not stop you from receiving care but may limit how we are able to support you. To help you decide, we will discuss with you how this may affect our ability to provide you with care and any other options you have. There may be instances when we need to share your information, even if you have told us that you do not want us to do this.
Our data retention policies and procedures are designed to help ensure that we comply with our legal obligations in relation to the retention. We are required by law to keep your information for varying lengths of time depending on individual circumstances and business requirements. This information is set out in our retention schedule. After this, your information will be deleted or archived.

Where we need to share your personal information, we will do this in line with the law (the main laws are the Data Protection Act 2018 and the UK General Data Protection Regulation).

If you are unhappy with the way in which your information has been handled, you should speak with the specific service in the first instance.
