Street works permit scheme

We operate a permit scheme used to control street works and works for road purposes on the highway network. These include work on apparatus installed in the street, and maintenance and improvement works to the road itself.

Our scheme improves the road network through better planning and management of activities. It reduces disruption to anyone using the road or pavement.

This applies to works carried out by us, partners and utility companies.

Other types of activity on the highway, such as builders’ skips and scaffolding are not included in this scheme and need separate licences or permits.

Permit scheme order

The Traffic Management (Leeds City Council) Permit Scheme Order 2020

Leeds City Council ("The Council") acting as the Local Highway Authority approves the permit scheme refened to as "The Leeds City Council Permit Scheme" and in exercise of its powers conferred by Section 334 (2) of the Traffic Management Act 2004, the Traffic Management Permit Scheme (England) Regulations 2007 (as amended), the Traffic Management Permit Scheme (England) (Amendment) Regulations 2015 and of all other enabling powers makes this Order.

Citation and commencement

1. This Order may be cited as the Traffic Management (Leeds City Council) Permit Scheme Order 2O2O and shall come into effect on 4th March 2020.

lnterpretation

2. ln this Order -

"The Leeds City Council Permit Scheme 2020" means the permit scheme prepared in accordance with Section 334 of The Traffic Management Act 2004 (as Amended) set out in the Schedule to this Order in terms commonly known as the "Leeds City Council Permit Scheme" which has been approved by Leeds City Council.

"specified streets" has the meaning given by regulation B of the Traffic Management Permit Scheme (England) Regulations 2007.

Effect of the Order

3. The Leeds City Council Permit Scheme which was brought into effect on 12 June 2012 by the Traffic Management (Leeds City Council) Permit Scheme Order 2012, and which was varied in 2015 to comply with the Traffic Management Permit Scheme (England) (Amendment) Regulations 2015, shall now be revoked in exercise of the powers confered by the Traffic Management Act 2004 and a new scheme shall come into force, to be known as the Leeds City Council Permit Scheme 2020.

Compliance with legislation

4. The Council hereby confirms that the Leeds City Council Permit Scheme 2020 complies with all aspects of the Traffic Management Permit Scheme (England) Regulations 2OO7 (as amended) and the Traffic Management Permit Scheme (England) (Amendment) Regulations 2015 and all other primary and secondary legislation enabling the Council to make this Order and does not exceed those powers.

Commencement of Permit Scheme

5. "The Leeds City Council Permit Scheme" set out in the Schedule to this Order shall come into effect on 4th March 2020.

Application of Part I of the Traffic Management Permit Scheme (England) Regulations 2007 (as amended)

6. Part I of the Traffic Management Permit Scheme (England) Regulations 2007 (as amended) shall apply to the specified streets within The Leeds City Council Permit Scheme.

* A discount of 30% will be applied where works are undertaken wholly outside of traffic sensitive times on traffic sensitive streets.

Variations

£45 for activities on category 0, 1 and 2 streets, and on 3 and 4 traffic sensitive streets.

£35 for activities on category 3 and 4 non traffic sensitive streets.

If a permit variation moves an activity into a higher fee category, the promoter will be required to pay the difference in permit fee as well as the permit variation.

No variation fee is payable if a permit variation is initiated by us.

Policy

Fees will not be payable in the following circumstances:

by the Highway Authority or contractor working on their behalf in respect of its own works for road purposes, however a record of the permit and fee will be used for reporting purposes and fee reviews
where a permit is deemed to be granted because the Permit Authority failed to respond to an application within the time periods
if the permit authority has to revoke a permit through no fault of the Promoter. Where a fee has been charged, the Permit Authority will either refund the fee paid or not charge for the subsequent permit
where several activity promoters are working within the same site and submit permit applications at the same time
where a promoter is using portable light signals and the heads are located on a road that is not part of the main works, but the lights are placed on a traffic sensitive street or cross boundary
in respect of a variation of a permit or of a condition attached to a permit if the variation was initiated by the Permit Authority, for example, via AIV
where a promoter completes works before the permit authority has had the opportunity to evaluate the permit application, for example, immediate works completed wholly within a weekend

Waiving or reducing fees

We have the option to waive or reduce fees at our discretion. A reduction may be applied where an activity is proven to provide significant economic benefit to the council.

Consultation

We consulted about the changes to the scheme. This ran for 30 working days from 11 October 2019.
